Definitions and Description
OutSee Service Agreement (hereinafter referred to as the "Agreement") is an agreement between the user (hereinafter referred to as the "User" or you) and OutSee, and OutSee will provide services to you in accordance with the contents of this Agreement. Please be sure to read and fully understand the terms and conditions. If you do not agree with any of the terms and conditions set forth in this Agreement or any subsequent modifications to the terms and conditions of this Agreement, please do not use OutSee and its related services. Your use of the Services will be deemed to constitute full acceptance of all the terms and conditions of this Agreement.
Intellectual Property Rights
- The content of OutSee and related services, including but not limited to copyrights, images, files, information, materials, site architecture, site screen arrangement, and web page design, are subject to the intellectual property rights of the individual developer, including but not limited to trademarks, patents, copyrights, and trade secrets, in accordance with the law.
- Please do not apply, modify, decompile, reproduce, publicly transmit, alter, distribute, publish, or publicly announce OutSee and the Services without the prior written consent of OutSee or its affiliates.
- Unless otherwise agreed in writing between you and OutSee, nothing in the TOS grants you the right to use any of OutSee' trade names, trademarks, service marks, logos, domain names, and other distinctive brand features.
- Respecting intellectual property rights is your obligation and you will be liable for damages in the event of a breach.
Privacy Protection
OutSee fully respects the protection of users' personal information, and OutSee' Privacy Policy describes how OutSee handles your personal information when you use OutSee and related services. By using OutSee and related services, you agree that OutSee may handle such information in accordance with the Privacy Policy.
User Conduct
- In using OutSee and related services, you should comply with the following laws and regulations:
- Law of the People's Republic of China on the Preservation of State Secrets.
- Copyright Law of the People's Republic of China.
- Regulations of the People's Republic of China on the Security Protection of Computer Information Systems.
- Regulations on the Protection of Computer Software.
- Regulations on the Administration of Electronic Announcement Services on the Internet.
- Regulations on the Protection of the Right to Information Network Dissemination.
- Network Security Law of the People's Republic of China.
- Other laws and regulations relating to computers and the Internet.
- Under any circumstances, OutSee may terminate the provision of services to a user at any time without prior notice once it reasonably believes that the user's behavior may violate the above laws and regulations.
- Users are prohibited from engaging in the following behaviors:
- Impersonate any person or organization, or falsely state or cause to be falsely believed that he or she is associated with any person or organization;
- Interfering with or disrupting OutSee and related services or servers and networks connected to OutSee and services, or failing to comply with the provisions of this Agreement;
- Intentionally or unintentionally violating any relevant Chinese laws, rules, regulations, ordinances and other legally binding norms;
- Without the express prior written permission of OutSee, to access the services, content, and data of the Platform by any means (including, but not limited to, any automated programs, scripts, software such as robot software, spider software, crawler software, etc.) and for any reason on its own, or by entrusting or assisting others to access the Services, content, and data of the Platform.
Disclaimer
We exclude liability for our inability to provide the Services properly due to the following reasons:
- Our system is down for maintenance or upgrade;
- Force majeure reasons such as typhoons, earthquakes, floods, lightning or terrorist attacks;
- Failure of your equipment hardware and software and communication lines and power supply lines;
- Due to your improper operation or use of our services through means not authorized or approved by us;
- due to viruses, Trojan horses, malicious program attacks, network congestion, system instability, system or equipment failure, communication failure, power failure, banking reasons, third party service defects or governmental actions.
